Public officials are prohibited from using public funds as consideration in a settlement for a nondisclosure agreement relating to a sexual assault or sexual harassment claim. Ariz. Rev. Stat. Ann. § 12-720(D).
A nondisclosure agreement may not prohibit a party from responding to a peace officer’s or prosecutor’s questions relating to an alleged criminal sexual offense or obscenity, or from making a statement, not initiated by that party, in a criminal proceeding relating to an alleged sexual offense or obscenity. Ariz. Rev. Stat. Ann. § 12-720(A), (B).
