The Disclosing Sexual Harassment in the Workplace Act (2018) makes NDAs and certain waivers of substantive and procedural rights unlawful related to sexual harassment or retaliation claims in an employment contract or policy. The law also protects employees from retaliation for refusing to enter into such an agreement. The law also requires employers with at least 50 employees to complete an annual survey disclosing the number of sexual harassment settlements in which the employer has entered. Md.
