An amendment (2021) to Nevada law limits employers’ use of NDAs, making contract and settlement provisions void and unenforceable if the provision restricts a party from testifying at a judicial or administrative proceeding related to the other party’s commission of a criminal offense, sexual harassment, discrimination based on race, religion, color, national origin,  disability, sexual orientation, gender identity or expression, ancestry, familial status, age or sex, or retaliation for the reporting of such  discrimination.
