Utah House Bill 55 (H.B. 55) was signed into law by Governor Spencer Cox on March 13, 2024, and became effective retroactively from January 1, 2023. It amends the Utah Anti-discrimination Act by rendering confidentiality clauses—including NDAs and non-disparagement agreements related to sexual misconduct—void and unenforceable when used as a condition of employment. This means employers cannot require employees to sign such agreements that prevent them from disclosing or discussing sexual harassment or assault incidents.
